1. Who we are

This website is operated by Somatics, Incorporated (“Somatics”, “we”, “us”), a North Carolina corporation, of 3925 Newhall Drive NW, Hickory, North Carolina 28601, United States.

2. What this policy covers

This policy covers this website and nothing else. It does not cover the Somatics Fitness & Nutrition mobile app, which collects a great deal more and has its own policy at Privacy Policy. It does not cover any third-party website you reach by following a link from here.

3. What this site collects today

As published, this website is a set of static pages. It has no accounts, no sign-in, no forms, no comments and no shopping basket. There is nothing on it to fill in and nothing to submit.

Specifically, as of the date at the top of this page:

• The site sets no cookies of any kind, and stores nothing in your browser’s local or session storage.
• The site runs no analytics, no advertising pixels, no attribution software and no session recording.
• Every file the site loads comes from our own domain. The site makes no requests to any third party, so no other company is told that you visited.
• The site does not track you across other websites or apps, and does not build a profile of you.
• We do not ask for your name, email address or any other personal detail anywhere on this site.

Server logs

Our hosting provider keeps standard web server logs, as effectively every website does. These records may include your IP address, the page you requested, the date and time, and the identifying string your browser sends about itself. They are generated by the hosting infrastructure rather than by anything we have added to the pages, and we use them only to keep the site running, diagnose faults, and investigate abuse or attacks.

4. What may change, and our reservation of rights

We reserve the right to change how this website works at any time, in our sole discretion, and to update this policy accordingly. In particular, we may in future:

• add cookies, local storage or similar technologies, whether our own or a third party’s;
• add website analytics or product measurement tools to understand how the site is used;
• add advertising, advertising pixels, conversion tracking, retargeting or measurement tags supplied by advertising networks;
• add forms, a newsletter sign-up, a contact form, a support widget, live chat or an account area, and collect the information you enter into them;
• add embedded third-party content such as video players, maps or social media widgets, which may set their own cookies;
• use the information collected by any of the above for the purposes set out in section 7, including measuring and improving the site and marketing our own products and services.

Where the law requires your consent before a particular technology is used, we will ask for it before using it. Where the law requires notice rather than consent, we will update this policy and change the date at the top before the change takes effect.

We may sell personal information, and may share it for cross-context behavioural advertising, as those terms are defined by California law and by the privacy laws of other states. Where we do, you have the right to direct us not to, and we will provide and honour the opt-out mechanisms those laws require, including a control for refusing the sale or sharing of your personal information and recognition of opt-out preference signals sent by your browser.

5. Cookies

This website currently sets no cookies. Because of that, there is nothing for you to consent to and no cookie banner is shown.

The site is built with a consent mechanism already in place but switched off, so that if we later add anything that requires consent, that consent can be requested and recorded properly from the moment it is added rather than afterwards. If and when that happens, this section will describe each cookie, what it is for, how long it lasts and who sets it.

6. Third parties

Our hosting provider stores and serves the files that make up this site, and generates the server logs described in section 3.

This site links to the App Store and to platform.fatsecret.com, and our app’s food data is supplied by FatSecret. Following a link takes you to a site we do not control, and this policy stops at that point. No information is sent to those companies unless you choose to follow the link.

7. How we use website information

We use the limited information described in section 3, and anything we may collect under section 4, to operate, secure, maintain and improve the website, to understand how it is used, to respond to you if you contact us, to market and promote our own products and services where we are permitted to do so, to detect and prevent abuse and security incidents, and to comply with law.

8. Your rights

Depending on where you live, you may have rights over personal information we hold about you, including to access it, correct it, delete it, receive a portable copy, object to or restrict how it is used, and withdraw a consent you have given. You have the right not to be treated differently for exercising any of them.

Because this website collects so little, in most cases we will hold nothing about you beyond the server logs described in section 3. To make a request, contact us using the details in section 12. We will verify who you are before acting, and will respond within the time the applicable law allows.

9. Children

This website is intended for adults, and the Somatics Fitness & Nutrition app is for people aged 18 and over. We do not knowingly collect information from children. If you believe a child has given us information, contact us and we will delete it.

10. Security

The site is served over an encrypted connection, and is configured with security headers that restrict what the browser is permitted to load and prevent the pages being embedded by other sites. No website can be guaranteed completely secure, and we cannot promise absolute security.

11. Changes to this policy

We reserve the right to revise, update, modify or replace this policy at any time, in our sole and absolute discretion. When we do, we will post the revised policy on this page and change the “Last updated” date at the top. Where a change is material and the law requires it, we will give notice before the change takes effect. Your continued use of the website after a change takes effect means you accept the revised policy.
